But the role of the Interstate Commerce Clause has been determined by the Supreme Court, which has gone back and forth on the issue of whether the federal government should have more authority than the states and under what conditions it should.
U.S. v. Lopez made it clear that while Congress did have authority over the states on matters on interstate commerce, it would have to be clear and demonstrable that the action was indeed a matter of interstate commerce.
